Terms and Conditions

 

 

Please read these terms and conditions carefully, they describe the legal obligations and liabilities of the Hirer and the duties and responsibilities of the company and they are part of the hire agreement.

 

Definitions.

 

The Company:

This refers to Alan Simpkins of 42 Brooke Road East, Liverpool L22 2AW trading as Halcyon Days Canal Boat Hire.

 

The Hirer:

This refers to the person named on the booking confirmation and on the boat handover certificate.

 

You:

This refers to the Hirer.

 

The Hire agreement:

This is a legally binding contract between the Hirer and the Company and as such must be accepted and agreed to by the Hirer as part of the booking process.

 

Booking:

When the Hirer submits a booking form together with a 25% deposit He/She is agreeing to these Term and Conditions.

 

Hire Agreement:

The hire agreement becomes valid when the Company sends the Hirer written (Email) confirmation of a booking.

 

Payment of Balance:

Payment of the full balance of the holiday cost must be made not less than 4 weeks from the date of the proposed holiday. In the event that payment is not made by this time the company reserves the right to re- let the said weeks without the refund of any deposit previously paid to the company. If a booking is made less than 4 weeks before the requested dates then the full price is payable at the time of booking.

 

Insurance:

The Company insures the boat and its equipment against loss or damage and against public liability claims, however the Company reserves the right to charge the Hirer for any malicious, negligent or intentional damage. Please note the Company’s insurance DOES NOT cover personal accidents or loss or damage to personal effects or cancellation.WE THE COMPANY HIGHLY RECOMMEND THAT THE HIRER AND CREW TAKE OUT THEIR OWN PERSONAL INSURANCE TO PROTECT THEMSELVES AGAINST THESE POSSIBILITIES.

The Company’s policy excludes damage arising from speeding, sill damage, malicious or intentional damage.

The Hirer will indemnify the Company from and against all costs, damage, expenses, liability and claims howsoever arising from the negligence, neglect or default of the Hirer to the extent that they are not covered by the Company’s policy.

 

Age limits and the Companies right to refuse a booking:

The Hire Agreement is a personal one between you and the Company and your identity is a material factor in the Company’s decision to enter into the Agreement.

You must be at least 21 years of age at the time of booking and you must present proof of your age and identity in the form of a Driving license (both parts), Passport or Birth certificate.

We reserve the right to refuse to hand over a narrow boat to any person who, in our opinion, is not suitable to take charge of the vessel. In the event of this happening, all payments will be refunded to the proposed hirer, who will then have no further claim against the Company. Furthermore we reserve the right to repossess the boat at any time if, in our opinion, the boat is being mishandled, used illegally or if the crew’s behaviour is considered detrimental to other waterway users. In the event of this happening, no portion of the hire fee will be refunded.

 

Security Deposit:

The Hirer must pay a refundable security deposit of £250.00 to cover any damage or loss to the boat or its inventory which will be returned to the hirer on satisfactory return of the boat and its contents in an undamaged condition at the end of the hire period, but does not cover for damage or loss caused by speeding, negligence, malicious intent or damage caused by contact with lock cills.

 

Hire Period – Handover and Return of the boat:

The weekly hire period commences with the handover procedure at 3.00pm on Saturday and ends at 10.00am on the following Saturday. Failure to return the narrow boat by this time will result in a charge of £15.00 per half hour or part thereof overdue.

During the handover the company will give any tuition, instruction, demonstration or trials that are deemed necessary by the company or the hirer.

In addition should the hirer be a novice or lacking in confidence the owner will gladly accompany the hirer and hirer’s party through the first lock, this service is free of charge and should be requested when payment is made in full.

 

Safety and Waterway Rules:

The Hirer agrees to comply with the following rules at all times for the Health and Safety of the persons onboard, and other persons and the boat and it’s property:-

The boat may not tow nor may it be towed by another craft, except under professional assistance in the event of an emergency.

Not to cruise between sunset and sunrise – as the boat is only equipped for cruising in daylight hours.

Observe all speed limits. Not to race or cruise at a speed which causes a wash or disturbs or inconveniences other waterway users.

Not to take or allow on board any portable heaters, barbecues of any kind, vehicles, lighting equipment, TV sets, any electrical appliances (except razors), inflammable liquids, gas cylinders, car batteries, firearms or any other items that might cause dangers or hazards.

Not to use the boat for business purposes. Not to allow on the boat at any one time any more persons than the maximum number of berths.

Not to carry onboard live fishing bait.

At all times to observe byelaws, navigational limits or instructions and advice of Canal & Rivers Trust or any other navigational authorities.

Please be aware that it is illegal to be drunk in charge of any vessel on British Waterways.

The Owner reserves the right at his discretion without liability to restrict cruising areas or routes in light of prevailing conditions.

Pets are allowed on the boat but must be put on the booking form. Hirers must provide their own pet baskets or blankets. All pets must be properly house trained or caged as appropriate, must not be left unattended, and must not be allowed on bedding or chairs. Pets are not covered under the company’s insurance policy and the Hirer shall be liable for the cost of any damage or extra cleaning required. A maximum of two pets are allowed on the boat.

Smoking is not permitted inside the boat.

 

Exemption:

The Owner shall not be liable for any matters arising from any cause beyond the Owner’s reasonable control, or not due to the Owner’s negligence or wilful default including (without limitation) death or personal injury of Hirers, their crew and passengers, loss or damage to property, non-fulfilment or interruption of the booking or breakdown delays, mechanical problems, defects, damage, restrictions or obstructions, repairs or damage to waterways, non availability of routes, navigational works, storms, floods, droughts, ice, or in respect of any consequential loss, damage, injury, expense or claim.

 

Cancellation:

Should the hirer cancel the booking, the Company will attempt to re-let the narrow boat at the full price. If this is successful, all monies less the deposit will be refunded. However if the Company does not succeed in re-letting the boat, the proposed hirer is legally responsible for promptly paying the balance of the hire fees. The hirer is advised to make their own cancellation insurance arrangements.

 

Repairs and Breakdowns:

The Hirer shall notify the Owner in the event of a breakdown, damage, theft or loss and provide full details and shall comply with all instructions from the Owner. The Hirer must not allow any repairs, adjustment or service without the Owner’s prior approval. The Hirer shall have no claim on the Owner as a result of breakdown or failure of the boat and it’s equipment, or for any delays caused by repairs to the boat.

 

Accidents:

You are in charge of the boat and are responsible for its safe navigation. In the event of any accident or damage involving You or any other people or any property You must:-- Obtain and record the name of any other boats and the names and addresses of any other people involved on the form provided by the Company (when available); - Notify the Company as soon as practically possible with full details of the accident and any damage sustained- Proceed in accordance with and follow the Company’s reasonable instructions UNDER NO CIRCUMSTANCES ADMIT OR ALLOW ANOTHER PERSON ABOARD THE BOAT TO ADMIT LIABILITY TO ANY OTHER PERSON. You are responsible for the boats navigation and will keep the boat and its equipment and contents in clean and tidy order during the Hire Period. The only maintenance to be carried out by you is lubricating stern tube and clearing weed hatches (as shown to you during the induction).

Children are not permitted to handle the boat without supervision.

You shall be responsible for getting the boat off mud banks or other grounding and for removal of weeds, rope or other matter from propellers and steering gear and for keeping the Company informed of any incidents of this nature.

You must notify and provide full details to the Company of any breakdown, damage, theft or loss involving the boat as soon as practically possible.

 

Hirer’s Motor Cars and Property:

Free parking is provided for the convenience of our customers, but we accept no liability for loss or damage to customers’ vehicles. You are advised not to leave valuables in your vehicles.
